For valuable consideration including photo prints which may be received after the session, I,
do hereby give participants of the Equine Photographers Network and the activity identified below, their assigns, licensees, successors in interest, legal representatives, and heirs, the irrevocable right to use images of myself or my horses and / or of the following property (list items or address of property)
which I own and have full and sole authority to license for such uses, regardless of whether said use is composite or distorted in character or form, whether said use is made in conjunction with my own name or with a fictitious name, or whether said use is made in color, black and white, or otherwise, or other derivative works are made through any medium for advertising, trade, or any other lawful purposes. I waive any right to inspect or approve the finished version(s), including written copy that may be created and appear in connection therewith. I agree that the photographer owns the copyright in these photographs and I hereby waive any claims I may have based on any usage of the photographs or works derived there from, including but not limited to claims for either invasion of privacy or libel.
I am aware, acknowledge and understand that if I agree to allow any animal or property under my ownership or control to be used as a model in said activity, that equine activities can be inherently dangerous, and in the course of such activities the animal or property may sustain injuries or become damaged, which injuries or damage may be permanent and/or result in disability and potentially death of the animal. I am aware and acknowledge that serious permanent bodily injury, disability or death may result to me and others and that property may be come damaged due to the handling of horses or by being in the vicinity of horse related activities. By signing below, I acknowledge that I have assumed the inherent risks associated with equine activities and/or equipment, and I am willing and able to accept full responsibilities for my own safety and welfare. I will therefore take all steps necessary to ensure my safety and welfare, including examination of animals and equipment as deemed necessary. I hereby release, and waive any claims that may arise, against the equine owner, agents, property owners, members, participants, representatives or guests of the Equine Photographers Network, and anyone present on their behalf or associated therewith at said activity, from liability due to any cause or incident. I confirm I am an independent contractor and that I am responsible for my own insurance and that I have no rights under Workmen’s Compensation laws
I acknowledge that this Release is intended to be as broad and inclusive as permitted by the laws of this State and that if any portion of the Release is found to be invalid, it is agreed that only such unenforceable provision(s) shall be excluded and that the balance of the Release shall remain in full force and effect. Proper venue for any dispute or claim shall only be in the State of New York.
I am at least 18 years old, and legally competent to sign this release. I agree that this release shall be binding on me, my legal representatives, heirs, and assigns. I have read this release and am fully familiar with its contents.
